General provisions<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>This Privacy and Cookies Policy (hereinafter the &#8220;Policy&#8221;) describes the rules for processing the personal data of users of the website available at akademiapilotow.com (hereinafter the &#8220;Website&#8221;), as well as the rules for using cookies and similar technologies.<\/li>\n\n\n<li>This Policy fulfils the information obligation set out in Art. 13 of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (OJ EU L 119, 04.05.2016, p. 1, as amended), hereinafter the &#8220;GDPR&#8221;, as well as the obligations arising from Art. 398 and Art. 399 of the Act of 12 July 2024 \u2013 Electronic Communications Law (hereinafter the &#8220;PKE&#8221;).<\/li>\n\n\n<li>Use of the Website is voluntary. This Policy does not impose any obligations on users other than those arising from generally applicable law.<\/li>\n\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 2. Personal data controller<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>The controller of the personal data processed in connection with the use of the Website is Piotr Kus, conducting business activity under the business name Piotr Kus Firma Handlowo-Us\u0142ugowa &#8220;PtasiSerwis.PL&#8221;, with its registered office in Zembrzyce, correspondence address: ul. Bia\u0142ka 260, 34-220 Bia\u0142ka, NIP (tax ID): 5521538271, REGON: 360878672, entered in the Central Registration and Information on Business (CEIDG), hereinafter the &#8220;Controller&#8221;.<\/li>\n\n\n<li>The Controller can be contacted about personal data protection matters:\n\n<ol class=\"wp-block-list\">\n\n<li>by e-mail \u2013 at: biuro@akademiapilotow.pl;<\/li>\n\n\n<li>by phone \u2013 at: +48 728 331 813;<\/li>\n\n\n<li>by post \u2013 at the Controller&#8217;s address indicated in section 1.<\/li>\n\n<\/ol>\n\n<\/li>\n\n\n<li>The Controller has not appointed a Data Protection Officer. All matters relating to the processing of personal data should be addressed directly to the Controller as indicated in section 2.<\/li>\n\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 3. Purposes, legal bases and scope of personal data processing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Controller processes the personal data of Website users for the following purposes:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A. Handling offer enquiries and course sign-ups (contact form \/ sign-up form)<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li><strong>purpose:<\/strong> responding to an enquiry addressed to the Controller, presenting a training offer and \u2013 if a training agreement is concluded \u2013 performing it;<\/li>\n\n\n<li><strong>legal basis:<\/strong> Art. 6(1)(b) GDPR \u2013 taking steps at the request of the data subject prior to entering into a contract, and performance of the contract; Art. 6(1)(f) GDPR \u2013 the Controller&#8217;s legitimate interest in handling enquiries addressed to the Controller;<\/li>\n\n\n<li><strong>scope of data:<\/strong> first name and surname, e-mail address, telephone number, the content of the enquiry, and any other data provided voluntarily in the message.<\/li>\n\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">B. Direct marketing (sending commercial information by electronic means and telephone contact)<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li><strong>purpose:<\/strong> sending information about the Controller&#8217;s training offer, promotions and events to persons who have consented to it;<\/li>\n\n\n<li><strong>legal basis:<\/strong> Art. 6(1)(f) GDPR \u2013 the Controller&#8217;s legitimate interest in direct marketing of its own services (Recital 47 GDPR); Art. 398(1) in conjunction with Art. 400 PKE \u2013 consent to the use of telecommunications terminal equipment for sending commercial information, which is a condition for the permissibility of a given communication channel;<\/li>\n\n\n<li><strong>scope of data:<\/strong> first name and surname, e-mail address, telephone number, the content of the marketing consents given;<\/li>\n\n\n<li>consent to direct marketing is separate from consent to conclude a training agreement, and withdrawing it does not affect the ability to use the Controller&#8217;s services. Consent may be withdrawn at any time.<\/li>\n\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">C. Running the Facebook fan page and Facebook Lead Ads forms<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li><strong>purpose:<\/strong> running the Controller&#8217;s fan page on Facebook, communicating with people who have interacted with the fan page (likes, comments, private messages, reactions), collecting submissions via Facebook Lead Ads forms, and keeping statistics;<\/li>\n\n\n<li><strong>legal basis:<\/strong> Art. 6(1)(b) GDPR \u2013 to the extent of taking steps at the request of the data subject; Art. 6(1)(f) GDPR \u2013 the Controller&#8217;s legitimate interest in communicating on social media and analysing statistics; Art. 6(1)(a) GDPR \u2013 solely to the extent that the user voluntarily provides data through a Lead Ads form or has given consent through the settings of their Meta account;<\/li>\n\n\n<li><strong>joint controller for data processed for the Page Insights feature:<\/strong> the joint controller is Meta Platforms Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) \u2013 under the rules set out in the Page Insights Controller Addendum and the Controller Addendum available on Meta&#8217;s websites, in accordance with Art. 26 GDPR. With respect to personal data provided to the Controller via Facebook Lead Ads forms, Meta Platforms Ireland Limited acts as a processor, under the Meta Lead Ads terms of use;<\/li>\n\n\n<li><strong>scope of data:<\/strong> first name and surname, profile name, image publicly visible on Facebook, the content of comments and private messages, data contained in reactions, and data provided voluntarily via Facebook Lead Ads forms (e.g. first name, surname, e-mail address, telephone number and other data entered by the user).<\/li>\n\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">D. Use of the Website and automatically collected data<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li><strong>purpose:<\/strong> ensuring the proper functioning and security of the Website, and keeping statistics;<\/li>\n\n\n<li><strong>legal basis:<\/strong> Art. 6(1)(f) GDPR \u2013 the Controller&#8217;s legitimate interest in maintaining and developing the Website;<\/li>\n\n\n<li><strong>scope of data:<\/strong> IP address, device identifier, web browser information, system data, date and time of the visit, data collected by cookies (in accordance with \u00a7 8 of the Policy).<\/li>\n\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 4. Recipients of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The recipients of Website users&#8217; personal data may be:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>the Website&#8217;s hosting provider and e-mail provider (LH.pl sp. z o.o., with its registered office in Pozna\u0144) \u2013 acting under a personal data processing agreement in accordance with Art. 28 GDPR;<\/li>\n\n\n<li>the provider of the sales contact management system \u2013 LH.pl sp. z o.o., with its registered office in Pozna\u0144 \u2013 for handling offer enquiries and data collected via forms;<\/li>\n\n\n<li>Meta Platforms Ireland Limited \u2013 to the extent indicated in \u00a7 3(1)(C);<\/li>\n\n\n<li>AIA. Us\u0142ugi biurowe. B\u0142a\u017cyczek A., Broda A. sp. c. (the Controller&#8217;s accounting office) \u2013 if a training agreement is concluded, to the extent required by accounting and tax regulations;<\/li>\n\n\n<li>the providers of invoicing systems \u2013 Fakturownia sp. z o.o., with its registered office in Warsaw (the Fakturownia.pl service), and the operator of the afaktury.pl service \u2013 if an invoice documenting a concluded agreement is issued, acting under personal data processing agreements;<\/li>\n\n\n<li>Autenti sp. z o.o., with its registered office in Pozna\u0144 \u2013 the provider of a platform for electronic document signing \u2013 if an agreement is concluded in electronic form;<\/li>\n\n\n<li>entities providing legal services to the Controller \u2013 if such a need arises;<\/li>\n\n\n<li>public authorities and other entities authorised under the law.<\/li>\n\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 5. Transfers of data outside the European Economic Area<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Users&#8217; personal data may be transferred to third countries (outside the European Economic Area, hereinafter the &#8220;EEA&#8221;) in the following situations:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>in connection with the use of the Facebook fan page and Facebook Lead Ads forms \u2013 data may be transferred to the United States within the Meta Platforms infrastructure; the transfer takes place on the basis of Commission Implementing Decision (EU) 2023\/1795 of 10 July 2023 on the EU\u2013US Data Privacy Framework and, where necessary, on the basis of the Standard Contractual Clauses approved by Commission Implementing Decision (EU) 2021\/914 of 4 June 2021;<\/li>\n\n\n<li>in connection with the use of the Google Analytics 4 and Google Ads tools \u2013 data may be transferred to the United States by Google LLC; the transfer takes place on the basis of Commission Implementing Decision (EU) 2023\/1795 of 10 July 2023 on the EU\u2013US Data Privacy Framework, under which Google LLC is a certified entity;<\/li>\n\n\n<li>in connection with the use of services of IT system providers, if their infrastructure extends beyond the EEA \u2013 the transfer takes place solely with the use of the mechanisms set out in Chapter V of the GDPR.<\/li>\n\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Information about the safeguards applied is made available by the Controller at the request of the data subject.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 6. Personal data retention period<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Personal data are stored for the period necessary to achieve the purposes for which they were collected, in particular:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>data provided in the contact form or course sign-up form (if no agreement is concluded) \u2013 for 12 months from the last contact or until a request for their erasure is made, whichever comes first;<\/li>\n\n\n<li>data of persons who have concluded a training agreement \u2013 in accordance with a separate information notice provided to trainees, in particular for 3 years from the completion of training (in accordance with point ORA.ATO.120 of Commission Regulation (EU) No 1178\/2011) and for 5 years from the end of the calendar year in which the tax payment deadline expired, with respect to tax and accounting documentation;<\/li>\n\n\n<li>data processed on the basis of marketing consent \u2013 until the consent is withdrawn or an objection is raised;<\/li>\n\n\n<li>data collected in cookies \u2013 in accordance with \u00a7 8 of the Policy, for the periods specified for the particular types of cookies;<\/li>\n\n\n<li>data collected automatically in server logs \u2013 for 6 months.<\/li>\n\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 7. Rights of data subjects<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Persons whose personal data are processed by the Controller have the following rights:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>the right of access to their personal data (Art. 15 GDPR);<\/li>\n\n\n<li>the right to rectification of data (Art. 16 GDPR);<\/li>\n\n\n<li>the right to erasure of data (the right to be forgotten \u2013 Art. 17 GDPR);<\/li>\n\n\n<li>the right to restriction of processing (Art. 18 GDPR);<\/li>\n\n\n<li>the right to data portability (Art. 20 GDPR);<\/li>\n\n\n<li>the right to object to the processing of data (Art. 21 GDPR) \u2013 in particular where processing is based on the Controller&#8217;s legitimate interest, and with respect to direct marketing, which is discontinued once an objection is raised;<\/li>\n\n\n<li>the right to withdraw consent at any time \u2013 with respect to processing based on consent (Art. 7(3) GDPR); withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal;<\/li>\n\n\n<li>the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urz\u0119du Ochrony Danych Osobowych, ul. Stanis\u0142awa Moniuszki 1A, 00-014 Warszawa) \u2013 if they consider that the processing of their data infringes personal data protection law.<\/li>\n\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The above rights are exercised at the request of the data subject, submitted in any form that allows the Controller to become acquainted with its content (in particular in writing or electronically), addressed to the Controller as indicated in \u00a7 2(2) of this Policy. The Controller considers the request without undue delay, no later than within one month of receiving it, and this period may be extended by a further two months if the request is complex.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Providing personal data on the Website is voluntary. However, failure to provide data in the contact form or the course sign-up form makes it impossible to contact the Controller or to conclude a training agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Controller does not make decisions concerning Website users based solely on automated processing, including profiling, that would produce legal effects concerning them or similarly significantly affect them (Art. 22 GDPR). To the extent that the user has consented to marketing cookies, their data may be profiled for ad-personalisation purposes (remarketing), which, however, does not produce the effects referred to in Art. 22 GDPR for the user.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 8. Cookies and similar technologies<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n\n<li>The Website uses cookies, i.e. small text files stored on the user&#8217;s end device (computer, phone, tablet). Cookies and similar technologies may contain data which \u2013 together with other information \u2013 may constitute personal data within the meaning of Art. 4(1) GDPR, in particular if they allow a person to be identified directly or indirectly.<\/li>\n\n\n<li>The legal basis for the use of cookies is Art. 399(1) PKE in conjunction with Art. 6(1)(a) GDPR (consent) \u2013 for cookies that require consent, and Art. 399(3) PKE \u2013 for cookies necessary for the functioning of the Website.<\/li>\n\n\n<li>The Website uses the following categories of cookies:\n\n<h4 class=\"wp-block-heading\">A. Necessary cookies (technical)<\/h4>\n\n\n<ol class=\"wp-block-list\">\n\n<li><strong>purpose:<\/strong> ensuring the proper functioning of the Website, including maintaining the user session, remembering the user&#8217;s cookie choices, ensuring security, and protecting against abuse;<\/li>\n\n\n<li><strong>legal basis:<\/strong> Art. 399(3) PKE \u2013 cookies necessary to provide the service requested by the user; their use does not require consent;<\/li>\n\n\n<li><strong>provider:<\/strong> the Website Controller (akademiapilotow.com); first-party cookies.<\/li>\n\n<\/ol>\n\n\n<h4 class=\"wp-block-heading\">B. Analytics cookies (statistics)<\/h4>\n\n\n<ol class=\"wp-block-list\">\n\n<li><strong>purpose:<\/strong> measuring Website traffic and analysing user behaviour in an aggregated way in order to improve how the Website works;<\/li>\n\n\n<li><strong>provider:<\/strong> Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) \u2013 the Google Analytics 4 (GA4) tool;<\/li>\n\n\n<li><strong>transfer outside the EEA:<\/strong> data may be transferred to Google LLC in the United States on the basis of Commission Implementing Decision (EU) 2023\/1795 of 10 July 2023 (EU\u2013US Data Privacy Framework), under which Google LLC is a certified entity;<\/li>\n\n\n<li><strong>legal basis:<\/strong> the user&#8217;s consent given via the cookie banner (Art. 399(1) PKE in conjunction with Art. 6(1)(a) GDPR);<\/li>\n\n\n<li>the use of these cookies is optional \u2013 the user may withdraw consent at any time by changing their preferences in the cookie banner or their web browser settings.<\/li>\n\n<\/ol>\n\n\n<h4 class=\"wp-block-heading\">C. The specific names of cookies and their retention periods may change on the side of the service providers (Google Ireland Limited). The Controller undertakes to verify the current state of cookies on the Website periodically (at least once a year) and to update this list accordingly.<\/li>\n\n\n<li>Consent to cookies other than necessary cookies is given through the user&#8217;s active action in the cookie banner displayed on the first visit to the Website. The absence of active consent (e.g. clicking the &#8220;X&#8221; symbol, merely closing the banner, or not accepting) does not constitute consent within the meaning of the GDPR and the PKE. Consent may also not be presumed from the mere fact of browsing the Website.<\/li>\n\n\n<li>Google Analytics 4 and Google Ads scripts are not launched before the user&#8217;s consent is obtained. The Controller uses the Google Consent Mode v2 mechanism, which ensures that data is transferred to Google only in accordance with the consent given by the user and to the extent covered by that consent.<\/li>\n\n\n<li>The user may change their cookie preferences at any time by:\n\n<ol class=\"wp-block-list\">\n\n<li>reopening the cookie banner on the Website \u2013 using the &#8220;Cookie settings&#8221; link available in the footer of every page;<\/li>\n\n\n<li>changing the settings of their web browser \u2013 so as to prevent cookies from being stored or to allow their later deletion;<\/li>\n\n\n<li>sending a request to the Controller at the address indicated in \u00a7 2(2) of this Policy.<\/li>\n\n<\/ol>\n\n<\/li>\n\n\n<li>Disabling analytics or marketing cookies does not prevent the user from using the Website, but it may affect how some of its features work. Disabling necessary cookies may cause the Website to malfunction, including preventing the use of forms, logging in, or saving user preferences.<\/li>\n\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 9. Security of data processing<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Controller has implemented appropriate technical and organisational measures to ensure the security of the personal data processed, in accordance with Art. 32 GDPR.
